Terms and conditions – Art de la Table

Preamble

The whole website “Chemin de Table” as well as any rights linked to it are property of BASQUIA SARL. Any reproduction total or partial will be conditioned to the consent of the owner. However, links towards the website are authorised.

1. Condition acceptance

Before placing any order, the customer accepts without any reservations the terms and conditions presented on this screen. Those terms and conditions apply to any commercial relation between the customer and the website "Chemin de Table”. Both the customer and "Chemin de Table” accept without any reservations.
Those terms and conditions will prevail against any other conditions present on any other documents, at the exception of a previous, formal and written agreement.

2. Products

Photographs of products are not contractual. If any mistake is present on those photographs, "Chemin de Table” will not be hold responsible for that matter.

3. Order

Automatic registering systems are considered as binding for the nature, the content and the date of the order. "Chemin de Table” confirms the order to the customer by sending an e-mail to the e-mail address given by the customer.
The sale will take place after "Chemin de Table” has confirmed the order.
"Chemin de Table” has the right to cancel an order if the customer shows a record of a litigious previous order.
The pieces of information given by the purchaser, when placing the order, are binding: in case of a mistake in the shipping address, "Chemin de Table” could not be held responsible for the impossibility to deliver the product(s).
Discounts applied to the amount of the cart cannot be added one to another. Thus, a discount gain for the order of a "godson” cannot be added to the discount offer by a promotional code.
"Chemin de Table” has the right to cancel any order if the product(s) is/are not available or for any other reason. In that case, the purchaser will be entirely reimbursed, as soon as possible.
The purchaser is able to find the record of every order he/she placed as well as every bills on the website in the "My account” part once connected thanks to his/her e-mail address and password created at his first order.

4. Delivery

The shipping costs are 6,90 € for delivery in France (metropolitan area), 25 € in Europe, and 30 € out of Europe by "colissimo” (French postal service).Once the order is confirmed, "Chemin de Table” will deliver to the shipper all the pieces of information given by the purchaser. The shipping company is contractually bound with "Chemin de Table” to deliver the products to the delivery address within 3 days to 2 months. To get a more precise estimation of the delivery, the purchaser can call "Chemin de Table” at the following number: +33 (0)6 03 51 27 75.
All orders placed on the website are intended for the purchaser's personal use. Customers or receivers are not allowed to sell the products bought online. "Chemin de Table” could not be hold responsible if the customer does not respect his/her obligation to pay tax on the product.

Delivery is made at the time slot decided with the purchaser by the direct delivery to the receiver or, if the receiver is not present, delivery can be made to an other person authorized by the purchaser. Delay does not allow the customer to ask for damages.
In case of a technical product, the customer should check that the product is functioning correctly and read the instruction manual.
In case of visible default, the purchaser is allowed to return the product following the conditions expressed in these Terms and Conditions.
Some events can prevent "Chemin de Table” to deliver the purchaser: war, riots, fire, strikes, accidents and the impossibility to supply. When the goods travel, the risk is supported by the receiver, who needs to check on the parcel at the arrival and to express, if needed, some reservations to the shipper in case of something is missing, or something is degraded.

For availability reason, "Chemin de Table” could deliver one order in several times. In that case, the customer is charged for only one delivery. If the purchaser wants two delivery points, two different orders are needed; delivery fees will be calculated consequently.
For breakage reason, "Chemin de Table” does not deliver glasses. Two pick-up points are available on demand: one in Lille and one in Paris.

5. Rights of retraction

The purchaser has 7 days after delivery to get an opinion on the product. Once those 7 days are passed, "Chemin de Table” will not be able to proceed to a refund.
In case of an exchange or a refund, all goods must be returned in perfect condition along with all accessories (if any), all gifts (if any), instructions manual (if any) and a copy of the initial invoice/delivery note with its original package without signs of usage at the address communicated by "Chemin de Table” after the refund demand. If those conditions are not respected, no refund will be possible.
If those conditions are fully respected, "Chemin de Table” is deemed to exchange or reimburse all amount paid but the return costs, and only after receiving the product(s).Particular case: "Chemin de Table” will not proceed to an exchange or a refund for any customised product (e.g. an engraved plate).

6. Price

The price is in Euros.
The price does not include the shipping cost.
The price indicated on the order confirmation is the final price and it is available for a month, tax included (VAT for France and EU).
The price includes the price of products as well as the handling, wrapping and stocking fees.

7. Payment

The price billed to the purchaser is the final price shown on the confirmation given by "Chemin de Table”. Payment has to be done the day of order with a credit/debit card (CB). You can also pay by check. Online payment allows the purchaser to make a payment in a safe environment. Your credit/debit card number will automatically be directed to the bank secured host server, without going through the online shop host server.
The order will be validated by "Chemin de Table” only after receiving the payment confirmation by the bank. If the payment is refused for any reason, the order will be cancelled automatically and the purchaser will be notified by e-mail. "Chemin de Table” reserves the right to refuse or cancel any order placed by a customer with an existing dispute.

8. Issue

The present contract is ruled by the provisions of French law.
"Chemin de Table” could not be hold responsible for any damages resulting of a bad functioning or a misuse of the product(s) sold. "Chemin de Table” could not be hold responsible for product modification by the manufacturer.
"Chemin de Table” responsibility is limited to the amount of the order.
The only law court competent for any matter linked to "Chemin de Table” is the commercial court of Paris.

9. Warranty

In any cases, "Chemin de Table” will not be hold responsible for the disrespect of regulatory or lawfully disposition in the country of destination. "Chemin de Table” responsibility will never exceed the value of the litigious product, at the time of the sale and "Chemin de Table” will have no possibility to have recourse to the manufacturer or the brand which produce the item.
During 6 months the client has the legal warranty of eviction and hidden damages (art. 1625 of French civil code). In this case the client has to prove the facts and the seller is legally bound to solve the problem (art. 1641 of French civil code), if the buyer goes to court. Then he/she has to do so within a "brief” delay (art. 1648 of French civil code).

10. Legal information

The information of nominative data is mandatory when apply to the mail order business because nominative data are needed to ship the order to the right person, to establish bill as well as warranty contracts.
The non-information of those data will lead to the non-confirmation of the order.
The treatment of nominatives data related to customers is supervised by the French law "Informatique et Libertés” (Computing and Freedom). The customer has the right to access those pieces of information for modification, rectification or suppression of his/her nominative data.
Furthermore, "Chemin de Table” commits not to communicate for free or for any price those data to anyone or any entity.
